1. General Terms and Conditions of Business (Betting Conditions) for sport betting
(Applicable from 18/11/2004 - replaces all earlier versions)

I. Betting Offer
 
  1. The betting company offers bets in the internet for all kinds of sporting events
     
  2. Our range of betting options is the sport bets presented by the betting company at the Internet addresses www.sportwetten.de, www.sportwetten.com and www.eurotip-online.com. The bets offered are predominantly made through online connection between the computer of the betting company and the Internet connection of the customer.

II. Fundamentals of the bet
 
  1. Every bet placed with the betting company is based on the following betting terms and conditions. By placing the bet, the betting client declares that he is aware of these betting conditions and acknowledges their application to the bet.
     
  2. By placing the bet, the betting client further declares that he has no knowledge of the outcome of the sporting event, that he is at least 18 years of age, and that he is contractually capable. If the betting client does nevertheless have knowledge of the outcome of the sporting event, the betting company reserves the right to require the return of the profit made and to claim compensation for damages.
     
  3. The betting company can refuse to accept bets without giving reasons and can determine a maximum stake or maximum winnings. In particular, the overall maximum stakes per bet and the specific maximum stakes for the different kinds of bet apply.
     
  4. In the event of fraud or an attempt at fraud, the betting client is immediately excluded, and any credit which may remain on his betting account after taking account of the expenses incurred by the betting company (e.g. processing fee of 10% of the credit) and of any damage caused by the betting client is paid out.
     
  5. Some countries do not permit active participation in sport bets. Each betting client has to take care that the applicable local, federal and national betting regulations are observed.

III. Placing the bet
 
  1. The betting company is not obliged to check the correctness or plausibility of the bet submitted, or the correctness of the data transmissions. Contractual or pre-contractual relationships between the betting client and the betting company with regard to the placing of a bet are excluded.
     
  2. For each fixture in a betting round, the betting company determines the point in time at which betting is closed. The close of betting for offers of the betting client to place a bet is determined in each case by the close of betting determined for the fixture selected by the betting client, which does not occur until within a betting round.
     
  3. The betting company reserves the right to alter, correct and update the established quotations, the respective close of betting for a fixture and the games programme, and to block games, combinations of games, and individual game outcomes. Further, a complete betting round and the acceptance of bets can be blocked at any time. Gaming contracts of a betting round which have already been concluded remain unaffected by this, taking into account the assessment rules in section 8.

IV. Coming into being of the bet
 
  1. The bet is concluded between the betting company and the betting client. Agreements with third parties are not binding for the betting company.
     
  2. The bet is concluded when the data transferred is confirmed by the betting company online before the actual start of the fixture.
     
  3. The betting company is not obliged to accept bets. In particular, bets will be paid back where
     
    • bets for a tipped fixture have been closed
    • the maximum stake for a combination bet, a system bet or a betting ticket has been exceeded
    • the maximum permissible total quotation for a combination bet has been exceeded
    • the maximum permissible winnings amount for a combination bet or a game order has been exceeded
     
    or the outcome of a fixture has been closed by the betting company or a combination bet submitted includes a cancelled fixture.
     
  4. The data stored at the betting company is exclusively determinative for the content of the bet. As an exception to this, the cases listed in sections 8e and 8f are to be taken into account where appropriate for the contents of the game contract.
     
  5. After a bet has been submitted and the complete data has been transferred to the betting company, a betting ticket number is assigned by the betting company on storage of all data in its headquarters. The betting ticket number serves the assignment of the betting ticket to the data stored in the headquarters of the betting company. In connection with this, the betting ticket is printed in the account statement of the betting client. The betting ticket includes the following essential elements:
     
    • the fixtures selected by the betting client, with the fixture number and the associated predictions and quotation
    • the overall quotation of each combination bet
    • the type of participation (normal game/system game)
    • the period of the game days
    • the stake
    • the betting ticket number assigned by the betting company
    • the customer account number
    • the current date and time.

  6. The betting company is entitled to refuse offers to conclude a bet where there are compelling grounds. In addition to this, withdrawal from the contract can be declared on compelling grounds. Compelling grounds exist, for example, where there is suspicion of a criminal offence, where the security of the betting transaction is not guaranteed, and when correct processing is not possible.
     
  7. Bets already made and accepted cannot be reversed or altered by the betting client.
     
  8. The betting client waives the receipt of the declaration that his offer of a contract has been accepted or rejected by the betting company or that the betting company has withdrawn from the bet.
     
  9. Where the bet is submitted after the beginning of the sporting event or contrary to the terms and conditions of business, the bet is invalid and the stake will be repaid. Where the bet does not come into being, the stake will be refunded against return of the betting ticket, when requested. Further entitlements are excluded.

V. Betting account
 
  1. As a matter of principle, only one account may be maintained per person. We reserve the right to dissolve all further accounts for a single client. The betting client is obliged, when requested by Sportwetten.de, to present a copy of his personal identification card or passport as positive identification of his person.

    In the event of a breach of this condition, we reserve the right to close the betting account. The credit on the betting account will then be paid out subject to retention of a processing fee in the amount of 15% of the credit balance insofar as this was legally obtained. Any bonus payments which may have been made by Sportwetten.de or profits from free tipping games are forfeited completely and are cancelled from the client account.
     
  2. The betting company maintains, without charge, a betting account for the betting client through which the financial transactions of the betting client with the betting company are carried out. This account is set up for the betting client without charge when he first registers, and the credit balance on this account is managed by the betting company in trust for the betting client.
     
  3. The money amounts provided by the betting client to the betting company (by bank transfer or by credit card payment) are credited by the betting company to the betting account.
     
  4. Insofar as the betting account of the betting client shows a credit balance, the betting client can place his stakes for betting from this credit balance. Winnings due are automatically credited by the betting company to the betting account of the client. No deductions or similar may be made from the amount of the winnings.
     
  5. Credit balances on the betting account will be paid out by the betting company to the betting client at any time by bank transfer or - if requested - by dispatch of a cheque to him personally, on receipt of appropriate, brief written instructions. The payment is, however, made only on the proviso that the amounts paid in by the betting client with the betting company (see section 5 b) are actually available to the betting company, i.e. that they have been permanently credited to the betting company.
     
  6. In variance from section 5e, where deposits are made by new clients by credit card the betting company can withhold the paying out of winnings until the credit card payment has been finally completed by the credit card institute. A client who at the time of the winnings payment in question has made regular betting transactions for less than two months is deemed to be a new client.
     
  7. Insofar as the betting company conducts bonus campaigns, the credits granted within the framework of such campaigns as a bonus paid to the betting account must be staked at least once by the betting client before they can be paid out to the client as credits of the betting account. Partial turnover and partial payouts of winnings are not possible. Should the deposit and the bonuses not have been turned over, or only partially, the bonus lapses when payout is requested.

    Bonus payments are as a matter of principle made voluntarily: there is no payment obligation on our part! For all bonus campaigns, Sportwetten.de establishes an individual period of validity which, if it is not separately stated on our Internet pages, can be requested at any time at info@eurotip-online.com.

    Please note the differing conditions of the bonus campaigns current at each time. These can be viewed separately on our homepage during the bonus period.

    For payments by bank transfer or by direct debit, the point in time of the receipt of the money on our account is determinative for granting bonuses.
     
  8. The betting client declares himself in agreement that his personal data can be stored by the betting company within the framework of recording of bets placed for as long as is necessary to complete the settlement of the relationship with the client.

VI. Betting stake + limits
 
  1. The betting client determines his stake himself, observing the rules for the stake determined by the betting company.
     
  2. The stake for a bet is at least 1 EUR.
     
  3. The betting company can determine differing maximum stakes for the individual sport offerings. The maximum total quotation for a combination bet is 1000:1. The maximum winnings obtainable from a bet is as a matter of principle 10,000 EUR, insofar as individual winnings limits for the different sports types do not determine lower limits.
     
  4. Winnings are limited in their amount only insofar as individual sport and bet types determine maximum stakes and maximum winnings.
     
  5. Of the winnings achieved in a week (all game events which are established within on weekly programme), no more than 500,000 EUR can be paid out immediately The winnings amount in excess of 500,000 EUR is not forfeited, but is paid out in weekly instalments of 10,000 EUR. No interest is paid on the amount being paid in instalments.

VII. Point in time and subject of the betting event
 
  1. A sport betting event as a rule takes place weekly between Monday and the following Sunday. For each week, the betting company will announce a programme which includes up to one thousand games, which may be composed of various types of sports (the games programme). For each fixture listed, the betting company announces the close of betting determined by it. The game days for the sport bet are determined by the respective games programme and can comprise all the days of a betting round, making it possible to participate daily in betting.
     
  2. The subject of the sports bet is the prediction of the outcome of the games to be selected (e.g. competitions, events) of the games programme of a betting round (combination bet). For each single prediction with respect to the selected fixtures of a combination bet, as a rule a selection is to be made between three game outcomes: the victory of the first-named team (home advantage, no neutral venue), a drawn result, and the victory of the second-named team (1-0-2). Differing proceedings, particularly for predictions of handicap games will be separately announced.
     
  3. For each possible prediction for a game, the betting company sets a quotation in advance, as a part of the games programme. The product of the quotations for the individual predictions gives rise to the overall quotation for a combination bet, whereby the amounts of the winnings which can be achieved are set in advance.
     
  4. When determined by the betting company, the results of partial segments can be separately assessed in addition to the end result. Partial segments are the first half, the second half, or other segments of a game.
     
  5. The games programme is announced by the betting company, and where appropriate altered, corrected or updated. The betting company is not obligated to publish game cancellations, changes of venue or times which become known.

VIII. Determination and assessment of the results
 
  1. In the sport bet, the correctness of the individual predictions within a combination or an individual bet are decided by the outcome of the respective game or sporting event. Determinative for the assessment is the result determined when the period of the game is over. An extension of the time for the game or a potential penalty shoot-out or another process for finding a decisive result is not taken into account in the assessment unless the betting proposal explicitly includes the extension or other decision process.
     
  2. If a game or sporting event is repeated, the first game or sporting event is assessed and not the repeat, regardless of the day on which it is held.
     
  3. A subsequent alteration or annulment of game results by sporting bodies is without significant for the assessment of the sport bet.
     
  4. Each game or sporting event is assessed without any respect to its description e.g. as championship match, cup game, friendly game etc..
     
  5. Differing from the quotations established, for a game or sporting event which is not played or which does not take place, or is
     
    • suspended
    • cancelled
    • not completed within a betting round or
    • changed to another betting round (event),

    the quotations for the event affected are generally set to 1.00 and every conceivable prediction of the game participant with respect to the fixture is treated as if it had correctly predicted the outcome of the game. The payment of the stakes to be refunded is governed by the regulations for paying out winnings (sections 5d, 9). Further entitlements are excluded.
     
  6. If it is not established that a bet was placed before the actual start of all selected games or sporting events, the quotations for the fixtures affected are set to 1.00, in variance from the quotations established, and the further consequences are governed by the conditions of section 8e.

    The same applies for the quotations for the game predictions within the framework of bets for which the home advantage in the underlying game is exchanged. Not affected by this are bets which were placed with the updated quotations which take account of the exchanged home advantage.
     
  7. For other time changes to a game or sporting event or to the close of betting of a game or a sporting event within a betting round (event), the associated predictions of the game participant are taken into account with the quotation established so long as the bet was placed before the actual start of the game or sporting event.

    For other changes to the venue, the quotations applicable at the time the bet was placed always continue to apply.
     
  8. If the results of partial segments are also assessed in addition to the final result, then in the case that a game is cancelled, the principles of section 8e apply both for the final results and for the partial segment. If not all of the partial segments included in the games programme are completed or if the game or sporting event is broken off in a second or subsequent partial segment, the results of the partial segments which were played or carried out to end are assessed: for the final result and the results of the partial segments which were not played or carried out to their end, the principles of section 8e apply.
     
  9. The principle of "play or pay" applies for all long-period bets. This means that where the sports participant or team does not take part, for any reason whatsoever, the bet is lost if the betting event for which the sports participant or team was registered takes place.

IX. Assessment and determination of winnings
 
  1. The basis for the determination of winnings is the data stored at the betting company, taking account of the following stipulated principles for the determination and assessment of the game and sport results. The assessment is carried out for the sport bet on the basis of the predictions with regard to the fixtures selected by the game participant.
     
  2. There are winnings when all individual predictions with regard to the outcome of the fixtures selected by the game participant within a combination bet are correct. Thus, in the sport bet, all betting participants win who within the framework of betting instructions have correctly predicted at least one combination bet completely correctly or one individual game.
     
  3. The betting company determines fixed (individual) quotations in advance for the various conceivable outcomes of each fixture. The multiplication of the individual quotations for the predictions made by the game participants with respect to the individual fixtures selected in a combination bet - taking account of the quotations set to 1.00 under sections 8e and 8f - gives the determinative overall quotations for the combination bet. The (individual) quotations are stated to two decimal places, and the overall quotation for a combination bet is (commercially) rounded to two decimal places. The amount of the winnings for a combination bet is calculated by multiplying the overall quotation for the combination bet by the stake.
     
  4. A system bet is composed of several combination bets. The amount of the winnings for a system bet is therefore calculated as the sum of the amounts of the winnings for the correctly predicted combination bets. The amount of the winnings can also be calculated by multiplying the ticked game stakes (game stakes per combination bet ) by the sum of the overall quotations of the correctly predicted combination bets.
     
  5. The total payout amount per bet instruction is rounded to an amount divisible by 0.10 EUR.
     
  6. The maximum winnings sum per customer per week (independent of the amount of the stake and the number of bets made) is 50,000 EUR. If a win exceeds the maximum sum per week, the excess amount is not carried forward to the next week, but lapses.

X. Complaints / applicable law
 
  1. Complaints can be made by the betting client up to 7 days after the date the bet is accepted by the betting company. Later objections are excluded. The betting client has to prove that the complaint has been received by the betting company.
     
  2. The betting client is obliged to check the bets confirmed by the betting company after they are received, and to object to them if appropriate. Later objections cannot be taken into account.
     
  3. All claims against the betting company arising from the bet expire if they are not claimed judicially within 13 (thirteen) weeks after the day following the date of the last fixture selected by the betting client. Winnings not claimed within this period lapse.
     
  4. In the event of disputes, German law is applicable.

XI. Scope and exclusion of liability
 
  1. The liability of the betting company for damages which are negligently caused by his legal representatives or culpably caused by his auxiliary agents before storing the data on the secure data medium are excluded.
     
  2. The betting company is liable to the betting client for all damages which are caused by gross negligence or maliciously after the data is stored on the secure storage medium at the betting company.
     
  3. No liability is accepted for communications errors or printing errors. The betting company has the right to correct obvious errors (wrong games, transposed quotations, incorrect winnings calculations or winnings bookings etc.) at any time without disadvantageous consequences for himself. Liability for the transmission of all sport news is excluded, since these are drawn from third party sources and the companies contractually bound to the betting company for this purpose are likewise not liable for the correctness of the transmission. There are thus in no circumstances entitlements to compensation for damages for incorrect communication of news insofar as no gross negligence or malicious intent is proven.
     
  4. The betting company is not liable for losses or damages which are caused by the banks, the postal service, the train services or other organisations. The betting company is further not liable for damages which arise from improper use of the betting account. Equally, all liability for damages is excluded which arise through criminal offences of third parties.
     
  5. The betting company is not liable for damages which result from force majeure or from external influences (fire, water, strike, unrest etc.) or other events for which the betting company is not responsible. Also excluded is liability for malfunctions or defects in technical facilities which are deployed by the betting company. In these cases, the stake will be refunded to the client. Further claims are excluded.

XII. Payments from the betting account
 
  1. In the case of large payouts where deposits have been made by credit card, we reserve the right retrospectively to require the deposits to be documented by the signature of the depositor and a copy of his personal identification card.

2. Betting conditions for different types of sports

1. Football
 
  1. Fixed price bets, handicap bets and combination bets - normal case
    For fixed price bets and handicap bets, the result after 90 minutes counts. Exceptions from this will be specified separately. The maximum winnings per single bet and per fixture or per combination bet is 10,000 EUR. These limits apply in each case separately for each outcome (1-0-2).
     
  2. Fixed price bets, handicap bets and combination bets - special case
    Independently of these winnings limits, the following differing regulations apply for the following football leagues.
    Football leagues:
    Italy B, Italy C
    Spanish 2nd division
    Greek 1st and 2nd divisions
    Turkish 2nd division

    Special regulation:
    The maximum winnings are 5,000 EUR. For combination bets, 5,000 EUR is also the maximum winnings amount per bet and fixture. For this purpose, the winnings amounts of all combination bets of one client for a fixture are treated together. As a matter of principle, the client is himself responsible for checking his maximum limit. These limits apply in each case separately for each outcome (1-0-2).

    Summary of maximum winnings limits (special case):
    Individual fixed price bet/fixture: 5,000 EUR
    Individual handicap bet/fixture: 5,000 EUR
    Combination bet/fixture: 5,000 EUR
     
  3. At least 3 combinations
    Where bets are accepted only from triple combinations per bet, this is to be stated separately when making the bet proposal!
    The maximum winnings per fixed price, handicap and combination bet per fixture is here €5,000. The calculation of the maximum winnings amount per combination bet is carried out as under section II.1.b.
     
  4. Special bets (goal minutes)
    For special bets, the result after 90 minutes counts. Exceptions from this will be specified separately.
    For the goal minutes up to 45 and up to 90 minutes, the after-game times apply in each case!
    The goals published on the website www.sportwetten.de under "Statistics" count as the official game result. Where information on goal minutes from sport information services is not clear, the result is taken from the respective official national football association.

2. Motor sports
 
  1. Head to head bets
    For head to head bets, the winner is the driver who occupies the better place in the final ranking in relation to his opponent. If neither of the two drivers finished the race, then for the purposes of the head to head bet, the driver who had completed the most laps wins. If both drivers had completed the same number of laps, the driver with the fastest lap time wins. In other cases, the bet is assessed as a repayment. The bet is valid when the two drivers in a head to head bet go to the starting position. In other cases, the stakes will be paid back. Head to head bets with the same driver (participant) cannot be combined with each other. In such a case, the higher quotation is assessed at 1.0. The assessment is made exclusively on the basis of the official race results of the Fédération Internationale de l´Automobile (FIA) on www.fia.com.
    The placings during the lap of honour are determinative. Later changes, disqualifications etc., have no effect on the assessment of the betting ticket.
     
  2. Pole Position
    The assessment for pole position (pole position and head to head bets) apply for the accumulated values from Qualifying I and II. Displacements of the ranking (start position), on any grounds whatsoever, have no effect on the calculation of winnings.

3. Tennis
 
  1. Start times
    All start times given for tennis meetings are stated with reservation. The actual start time will be taken into account in determining the result, and corrected accordingly. Where a tennis match starts before the stated anticipated start time, bets which were placed after the actual start of play will be valued with the quotation 1.00.
     
  2. Fixed price and handicap bets
    A fixed price bet is won when the player correctly tips the outcome of the match. The tennis match must be played to end by both the players. If the match is broken off for any reason whatsoever, or if a player concedes, the game is treated as broken off and the match stakes are paid back!
    The maximum winnings per bet and per tennis match is €10,000. For this purpose, the winnings amounts of all individual and combination bets of one client for a tennis match are treated together. As a matter of principle, the client is himself responsible for checking his maximum limit. Betting stakes going beyond the maximum winnings will be paid back to the client proportionally and credited to the client account.

4. US Sports
 
  1. Fixed price and handicap bets
    For US sports NBA, MLB and NFL, the official final results incl. overtime apply. For MLB games, at least 5 innings must be played for the result to be officially assessed. For total bets on MLB games, at least 8˝ innings must be played when the home team is leading, otherwise 9 innings, for the bet to be officially assessed. For NHL and MLS, the official results without overtime apply. The maximum winnings limit per individual fixed price or individual handicap bet is €10,000 each.

    The maximum winnings limit for a combination bet is €10,000.

5. Basketball (other than NBA)
 
  1. For basketball, the official results including overtime apply. The maximum winnings limit per individual fixed price or individual handicap bet is €5,000 each.
    The maximum winnings limit for a combination bet is €5,000.

6. Handball
 
  1. For handball, the official results without overtime apply. The maximum winnings limit per individual fixed price or individual handicap bet is €10,000 each.
    The maximum winnings limit for a combination bet is €10,000.

7. Ice hockey (other than NHL)
 
  1. For ice hockey, the official results without overtime apply. The maximum winnings limit per individual fixed price or individual handicap bet is €10,000 each.
    The maximum winnings limit for a combination bet is €10,000.

8. Golf
 
  1. The maximum winnings limit (payout limit) per individual fixed price bet on one player is €10,000 per bet and client. The maximum winnings limit for a combination bet is €10,000 per bet and client. Within multiple combination bets, it is only permissible to bet on individual players up to the maximum winnings limit (payout limit) of €10,000. If the limit is exceeded, the assessment of the player who intersects with the maximum winnings limit is made within further combination bets with substitute odds of 1.0. This also applies for combinations of head to head bets. The maximum winnings limit per head to head bet is €5,000 per bet and client.
     
  2. For long-term bets on a golf player, the bet is lost when the player does not take part in the tournament.
    Head to head bets are valid when both players take part in the betting round (tournament, round, etc.). Head to head bets with the same participants cannot be combined with each other. Alternatively the higher odds are assessed at 1.0. For head to head bets, the winner is the player who:

    1. has played more rounds
    2. has taken fewer strokes.

    In the case of withdrawal or disqualification after one round, the result up until withdrawal or disqualification counts. In the case of cancellation of a round (on any grounds whatsoever), the stakes will be repaid.

9. Winter sports
 
  1. Ski: If both skiers are disqualified in a H2H bet, the stake will be refunded (odds 1.0).
     
  2. Slalom/Giant slalom: In a H2H bet, at least one rider must reach the 2nd round for the bet to be valid. If a rider is disqualified in the first round, and the other rider not until the second, the bet is valid.
     
  3. Nordic combination: both participants in a H2H bet must start in both disciplines (ski jumping, long distance) for the bet to be valid.
